BIRMINGHAM TECH WEEK 2024 CONTEST RULES

These rules are the standard terms and conditions applicable to the contest administered by Moravio s.r.o., with registered office at Kukučínova 799/10, Hulváky, 709 00 Ostrava, ID no.: 29265266, registered at regional court in Ostrava under the file number C 56452 ("Moravio"). When you click to agree to the rules when this option is made available to you or when you otherwise enter in the contest, you accept these rules.

ELIGIBILITY TO PARTICIPATE

To be eligible to participate in the contest, you must be the sole owner of all right, title and interest (including copyright) in and to the contest entry (project) submitted in connection with the contest.

By participating in the contest, you grant Moravio and the Event Organiser a non-exclusive, perpetual, worldwide, royalty-free, transferable, and sublicensable licence to use, reproduce, modify, distribute, display, and create derivative works of any materials you submit in connection with the contest (contest entries). This licence includes, but is not limited to, the right to use the materials for promotional, commercial, or any other purposes, without any obligation to the participant.

By participating in the contest, you further agree that Moravio and Event Organiser may record the prize handover by video capture, photographs, or otherwise. These recordings may be used by Moravio and the Event Organiser for promotional or commercial purposes. If you win, you also agree that your identity may be shared on Moravio’s and the Event Organiser's social media channels.

ENTRY TO THE CONTEST

If you are eligible to participate in the contest, you may enter the contest by filling in the contest form available on the website https://poc.moravio.com/. This means that you shall:

1 . upload the requested information on the above website (this includes in particular, but not exclusively at your name, email, phone number, and information about the intended project)

2 .confirm your acceptance of these contest rules.

Entry form for the contest is open on the website until 1st December, 12:00PM, after which time the contest will be closed and no other entries shall be accepted. Moravio reserves the right to close the form for further entries at any moment, either before or after the listed time and date.

CONTEST ENTRY RULES

Each contestant can submit one entry, unless otherwise indicated. In the case of multiple entries, only the first eligible entry will be considered, and the remainder will be void. 

Entries must be received prior to the end of the applicable contest period to be eligible for entry.

Moravio shall have the right at any time to require proof of identity and/or eligibility to participate in the contests Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to Moravio for the purpose of the contests must be truthful, complete, accurate and in no way misleading. Moravio reserves the right, in its sole discretion, to disqualify any contestant should such a contestant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.

Each contestant further represents and warrants that the submitted project: 

1. does not contain any material that is libellous, defamatory, profane or obscene;

2 .is original and all right, title, and interest (including copyright) therein and thereto is owned and/or controlled by the contestant to the full extent necessary to enable Moravio to use the submitted project as contemplated by these rules; and 

3. does not infringe on the intellectual property or other statutory or common law rights of any third party.

SELECTION AND NOTIFICATION OF WINNER

Following the end of the applicable contest period, the winner of the contest will be selected by a jury composed of representatives from Moravio and one or more members from the Event Organizer team. The jury will evaluate the quality of the submitted project in determining the winner, and select the project which, in its sole discretion, is of the highest quality.

The winner will be notified within 2 weeks after the end of the contest period by email announcement sent to the winner's email address stated in the contest entry form. Moravio reserves the right to extend the deadline for notification of winner in case of more contestants than anticipated.

Before being declared a winner, the selected contestant may be required to sign and return a legal agreement and release that confirms his or her: (i) eligibility for the contest and compliance with these contest rules; (ii) acceptance of the prize as offered; (iii) release of Moravio and Event Organizers and each of their respective parent companies, subsidiaries, affiliates and/or related companies and each of their employees, directors, officers, suppliers, and agents from any and all liability for any loss, damages, cost or expense arising out of participation in the contest, or the acceptance, use, or misuse of any prize, including but not limited to lost profit, or from any and all claims of third parties arising therefrom; and grant to Moravio of the unrestricted right to produce, reproduce, convert, publish, broadcast, communicate, and otherwise use or re-use the its name, image, trademark, likeness, comments, and/or biography in any and all media now known or hereafter devised in connection with publicity related to the contest. The executed release must be returned within 2 business days of the date indicated on the accompanying letter of notification or verification as a winner, or the selected contestant will be disqualified and any rights he or she may have to the prize will be forfeited.

If the selected contestant does not respond within 2 business days of notification, it will be disqualified and will not receive a prize and another entrant may be selected (as determined by Moravio and embers from of the Event Organizer team in their sole discretion) until such time as an entrant satisfies the terms set out herein. Moravio is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification.

PRIZE AND ITS DELIVERY

The prize for the contest is the creation of a Proof of Concept (PoC) for the winner's planned product in accordance with the submitted project. The PoC will be limited to a maximum of 10 man-days (MD) of development capacity, meaning it will be a small-scale PoC focused on demonstrating key aspects of the project.

Given the nature of the prize, the winner will be contacted by Moravio with instructions on how to claim the prize. Delivery will proceed approximately as follows: after the winner is announced, the parties will agree on the project timeline. At the start, the project scope will be clarified, and Moravio may request additional materials or information. Development will then take place, with the final outputs delivered to the winner at the end. The winner has no right to claim remedy of defects in the outputs, nor any other rights arising from defective performance. Moravio is not responsible for loss, damage, or non-delivery of the prize. Moravio reserves the right to require the winner to sign a standard service agreement before commencing the project.

Prize must be accepted as awarded and cannot be transferred, assigned, substituted, or redeemed for cash, except at the sole discretion of Moravio. Any unused portion of a prize will be forfeited and have no cash value. 

All incidental costs and expenses not specifically referred to herein as part of the prize description are the sole responsibility of the prize winner. The winner shall not seek any reimbursement from Moravio. 

The winner is required to pay income tax on winnings if its value exceeds the statutory limit.

PRIZE AND ITS DELIVERY

By entering a contest, each entrant releases and holds Moravio and Event Organizers harmless from any and all liability for any loss or damage of any kind to the entrants or any other person resulting directly or indirectly from acceptance, use or misuse of any prize, participation in the contest, any breach of the contest rules, or in any prize-related activity. Each entrant agrees to fully indemnify Moravio and Event Organizers from any and all claims by third parties relating to the contest, without limitation.

Moravio and the Event Organisers reserve the right to: 

  1. exclude from the contest any project which is unlawful, indecent, or otherwise inappropriate
  2. not select any winner if, in Moravio and the Event Organisers sole discretion, none of the submitted projects meet the required standards or expectations
  3. shorten, postpone, suspend, or cancel the contest without refund without providing any reason
  4. not provide any prize; the prize is not legally enforceable
  5. substitute a prize of equal or greater value if a prize cannot be awarded for any reason
  6. revise and update these contest rules from time to time in its sole discretion; all changes are effective immediately and will be notified on the website
  7. not respond to contestants' enquiries.

DATA PROTECTION

Moravio as personal data controller informs you about personal data processed, for what purposes and what rights do you have.

Moravio processes personal data though website form available here https://poc.moravio.com/. Personal data that Moravio will process includes: your name, e-mail address, phone number, information about submitted project. All of this personal data will be processed for the purpose of evaluation of this contest and to contact you in connection with this contest. Thus, Moravio may send you some type of e-mail communication for this purpose. Once contacted, Moravio may ask for more information. According to the GDPR Moravio will only use all your information to fulfil the reciprocal relationship that the participation on contest creates between you and Moravio. The GDPR has this in mind and allows Moravio to process personal data in this way for the performance of contractual relationship (specifically, this is in Article 6(1)(b) of the GDPR). As Moravio has to keep accounts, for example, Moravio may also use some of your information for the performance of legal obligations (as modified in Article 6(1)(b) of the GDPR). Moravio will include your name and email in the newsletter list, unless you opt out before completing the registration. Moravio may use your information for this direct marketing based on legitimate interest under Article 6(1)(f) of the GDPR. If you do not wish to receive marketing communications from us, please tick the "I do not wish to receive marketing communications" check-box before submitting the form. If you do not opt-out before completing your registration, you may do so at any time in any communication Moravio sends you.

Your personal data will be shared only with the Tech West Midlands and provider of web platform where the personal data will be stored (WebFlow).

Moravio will process all personal data for the duration of the contest. Also, Moravio may process personal data for the community sharing and also there may be some additional actions associated with the contest (such as second round of choosing of other winners in contest.  After that, Moravio will delete the information, or Moravio will keep only the information for sending newsletters.

Under the GDPR, you have the right to access, rectify or delete your personal data or restrict processing. You can also object to processing and request data portability. You can exercise all rights in accordance with Articles 15 to 22 of the GDPR. To exercise your rights, please email Moravio at info@moravio.com.

The processing of personal data is supervised by the Office for Personal Data Protection. You can also lodge a complaint with this authority if you have any doubts about how Moravio processes personal data. More information is available at www.uoou.cz.

FINAL ARRANGEMENTS

The contest shall be construed and evaluated according to applicable laws of the Czech Republic. Any dispute relating out of or in relation to the contest shall be resolved by the courts of the Czech Republic.
